Identification Of Hazardous Waste
As Provided in New Hampshire’s Hazardous Waste Rules, Env-Wm 100-1000

The New Hampshire Hazardous Waste Rules, Env-Wm 110.01(b)(56) defines hazardous waste as any solid, semi-solid, liquid contained gaseous waste, or any combination of these wastes, which:

  1. May cause or contribute to an increase in irreversible or incapacitating reversible illness.
  2. Poses a present or potential threat to human health or the environment if improperly managed.
  3. Has been identified as a hazardous waste by the Waste Management Division.
Characteristics of a Hazardous Waste
  1. Is it ignitable? (flash point <60° Celsius or <140° F as per Env-Wm 403.03)
  2. Is it corrosive? (< 2.0 or > 12.5 as per Env-Wm 403.04)
  3. Is it reactive? (reacts violently with water or air; is explosive, or cyanide or sulfide-bearing– see Env-Wm 403.05)
  4. Does it fail the Toxicity Characteristic Leaching Procedure (TCLP)? (contains heavy metals, pesticides, herbicides or organics listed in Env-Wm 403.06)
(If you answered "yes" to any of the above, the waste is considered hazardous.)

Lists of Hazardous Wastes

  1. Is it listed in Env-Wm 402.04? (acutely hazardous wastes, P-listed)
  2. Is it listed in Env-Wm 402.05? (toxic hazardous wastes, U-listed)
  3. Is it listed in Env-Wm 402.06? (generic industrial process wastes, F-listed)
  4. Is it listed in Env-Wm 402.07? (specific industrial process wastes, K-listed)
  5. Is it a hazardous waste mixture pursuant to Env-Wm 404.01?
  6. See Chapter Env-Wm 400 of the Hazardous Waste Rules for additional information.
(If you answered "yes" to any of the above, the waste is considered hazardous.)
