Requirements for Owners of Regulated
Underground Storage Systems with Secondary Containment

Owners of regulated underground storage tank (UST) systems with secondary containment should be aware of the following requirements.

1. Permit
Env-Wm 1401.07 Permit to Operate. An owner of a regulated UST must obtain and maintain a valid Permit-to-Operate. This permit must be displayed in a prominent location for all to view.

2. Transfer of Ownership:
Env-Wm 1401.08 Transfer of Facility Ownership. The owner is required to provide the buyer with all documentation and information pertaining to the maintenance of the UST system over the years. When the property, is sold the seller must furnish the buyer with all tank and piping records. The new owner is responsible for registering the facility. 3. Water in Tank
Env-Wm 1401.16 Unusual Operating Conditions. The owner must report any unusual operating conditions such as water in the tank to DES. This can be the first sign of a problem or possible leak.

4. Check Leak Prevention Equipment

1. Env-Wm 1401.25 Spill Containment and Overfill Protection. The owner must check spill buckets for oil and water, and if present, the oil and/or water must be removed.
2. Env-Wm 1401.30 Release Detection for Piping. The owner must make sure line leak detectors on pressurized piping systems are functioning correctly. Line leak detectors must be tested at least once a year to confirm they are operating properly. 3. Env-Wm 1401.31 Operating of Leak Monitoring Equipment. The owner must make sure that all interstitial monitors and sensors are in good working condition at all times. These devices must be tested at least once a year to confirm they are operating properly. If any monitor or sensor is not working correctly, they must be repaired or replaced immediately.
