Violator Agrees to Pay $4,000 for Wetlands Violations
Concord, NH - The New Hampshire Department of Environmental Services (DES), announced today the payment of administrative fines in the amount of $4,000 by Christopher and Tracey Nelson of Jefferson, N.H. The Nelsons agreed to pay the fines without a formal hearing for violations of the state’s wetlands regulations in Jefferson. Violations documented on the property included the dredge and fill of forested wetlands without a permit from DES, the installation of a culvert within a jurisdictional wetland and stream channel without a permit, and failure to install and maintain erosion control measures on the property.
Christopher and Tracey Nelson, owners of property on Turnpike Road, in Jefferson, agreed to an administrative fine in the amount of $8,500, with $4,500 suspended based on their cooperation and response to resolve the violations. The suspended amount is contingent upon Christopher and Tracey Nelson remaining in compliance with the agreement as well as statutes, rules and permits under the purview of DES for a period of two years.
DES will continue to monitor site conditions on the property through 2011 to ensure restoration success.
