What Information is Needed for an Air Permit Application

1. Demonstration of Title, Right and Interest in Propert

Consistent with Env-A 605.02, applicants must certify by affidavit that the owner or operator has right, title, or interest in all of the property that is proposed for development or use, because the owner or operator owns, leases, or has binding options to purchase all of the property proposed for development or use. An example affidavit is provided at Sample Ownership Affidavit Adobe Acrobat.

Where the applicant is not the legal owner of the source or device to be permitted (e.g., a consultant), a written statement establishing that the applicant has the requisite authority to act on behalf of the owner for purposes of the permit application must be included (Env-A 605.03).

2. Air Dispersion Modeling Impact Analysis Requirements

For all permits, as required by Env-A 606.02, the applicant must:

  • Request that the Division conduct a complete air pollution dispersion modeling impact analysis as part of its review of the application (Please include elevation view drawings of all structures on the property.); or
  • Submit the results of a complete air pollution dispersion modeling impact analysis, conducted in accordance with 40 CFR 51, Appendix W as documented in the NHDES-ARD "Procedure for Air Quality Impact Modeling"

3. Submit Supporting Data

All of the applicable support data cited in Section III of the Form ARD-1 should be included with the permit application.

4. Title V Requirements in Accordance With Env-A 1709

Title V permit applications have further information requirements under Env-A 1709.
