In May 2002, Governor Shaheen issued Executive Order 2002-04 . This order calls for the Department of Environmental Services (DES) to notify owners of property with drinking water wells and owners/operators of public water supply wells concerning potential sources of groundwater contamination. The notification requirement covers groundwater contamination discovered on or after July 1, 2002. If DES obtains information that contamination was detected in groundwater samples collected from either a monitoring well or a drinking water well, then owners of property with a drinking water well, located within 500 feet of the contaminated well, will receive notification by certified mail. Public water suppliers will also be notified if the contamination is found to be within the wellhead protection area of the public water supply.
This notification program applies to contamination resulting from human activities, detected at concentrations above state groundwater standards. In addition, the same notification process will be used if the concentration of the gasoline additive MtBE is discovered at 5 parts per billion or greater. The requirements for notification do not apply to naturally occurring contamination such as arsenic or radon.
