Underground Storage Tank Program
Underground Storage Tank Closure Notification

Purpose
Allows DES the opportunity to attend the removal (closure) of an underground storage tank and if evidence of contamination is discovered, assist the owner with timely answers to questions regarding site remediation.

Applicability
The owner of a regulated underground storage tank (UST) facility must provide closure notification to the Underground Storage Tank Program least 30 days prior to any scheduled UST system permanent closure. A regulated UST facility is any facility having an individual tank capacity greater than 110 gallons or of unknown size that store a regulated substance. Does not apply to owners of residential heating oil USTs and non-residential heating oil USTs not larger than 1,100 gallons.

Fee
None .

Processing Time
The owner must notify the Underground Storage Tank Program at least 30 days prior to the scheduled UST system permanent closure. C losure notification received less than 30 days prior to the scheduled UST system permanent closure will be accepted during an environmental emergency.

Term/Renewal
None.

Modification/Amendments
The Underground Storage Tank Program must be notified of any closure schedule changes as soon as possible.

Transferability
Not transferable.

Appeals
Any person aggrieved by a final decision can appeal to the Waste Management Council in accordance with RSA 21-0:9.
