DES is empowered to take the following disciplinary actions:
- Administrative fine
- Administrative order
- Mandatory participation in a program of continuing education
- Written reprimand
Fines
DES, with the approval of the Board, has adopted Env-C 616 to establish a schedule of administrative fines (go to page 75 of the rules and/or search for Env-C 616 within this pdf).
The Board has also published an abbreviated version of the fine schedule:
Appeals
Appeals to Administrative Orders and Administrative Fines must be filed with the Board within 30 days of the date of the decision.
Other Penalties
Chapter 482-B:16 also provides for civil and criminal penalties for violations of RSA 482-B and the rules adopted under that chapter.
