Public Pool and Spa Program
Public Bathing Facility Approval

Purpose
To ensure water quality, the health and safety of persons using public bathing places and environmental protection in and around public bathing places.

Applicability
Public bathing facilities includes, but is not limited to, swimming pools, spas, special recreation pools, and therapy pools at hotels, motels, health facilities, water parks, condominium complexes, apartment complexes, youth recreation camps, public parks, and recreational campgrounds, or camping parks. Public bathing facilities does not include any bathing facility which serves three or fewer living units and which is used only by the residents of the living units and their guests.

Fee
$100 application fee.
 
Processing Time
Typically 15 business days to review a complete application.

Term/Renewal
There is no term limit since pre-operational and on-going inspections are conducted to ensure compliance with the requirements of Env-Wq 1100.

Modification/Amendments
Any changes to the design or specifications of an approved plan must be submitted in writing to the Public Pool and Spa Program for approval prior to construction.

Transferability

Appeals
Any person aggrieved by a final decision can appeal to the Water Council in accordance with RSA 21 0:7 .

More Information
If any requirement in Env-Wq 1100 conflicts with a local ordinance, the more stringent requirement shall apply.
The operational requirements for some facilities may require obtaining additional permits or approvals from DES.
